The current amendments are mainly aimed at bringing the regional legislation in line with the federal one, according to the official portal of the Moscow Regional Duma. The sphere of regulation of the regional law now includes not only monuments of regional and local significance, but also of federal ones. As the basis for the policy of local protection bodies, the law defines “ensuring and realizing the rights of citizens to access cultural values; preservation, creation, dissemination and development of cultural values ”, as well as the development of charity, patronage and sponsorship in this area.
The most important was the amendment that obliged regional authorities to keep records of objects that are not included in the state register, but are of historical and cultural value, and objects "possessing signs of cultural heritage objects" in accordance with Article 18 of the Federal Law "On cultural heritage objects (historical monuments and culture of peoples) of the Russian Federation”. Commenting on this news for the Archi.ru portal, Evgeny Sosedov, Deputy Chairman of the Council of the Moscow Regional Department of VOOPIIiK, noted that in Moscow, such objects have long been recorded within the framework of maintaining a list of "declared" objects, and in the region until now, on the contrary, it was actually stopped due to extreme the complexity of the procedure, as a result of which a significant number of valuable objects were lost. With the appearance of the new list, it will be much easier to protect the monuments, Yevgeny Sosedov believes, since any construction and household work will have to be carried out provided that they are preserved. The basis for the inclusion of objects in it by the regional Ministry of Culture can be statements of citizens and public organizations.
However, according to Evgeny Sosedov, even these progressive additions to the regional law on monuments are unlikely to mitigate the negative consequences of the recent liquidation of Rosokhrankultura. According to the expert, with the disappearance of this structure, the Moscow region turned out to be the least protected among other subjects of the Russian Federation, since a specially authorized body for the protection of heritage objects has not yet been created here. Unlike the capital and its Moskomnaslediya, only one department within the local Ministry of Culture is engaged in monuments in the region, whose several dozen employees are simply not able to control more than 7 thousand objects. In addition, according to Sosedov, the dissolution of Rosokhrankultura Normal 0 false false false is the abolition of the only independent control and supervisory body in this area, which is not burdened with either the distribution of finances, like the Ministry of Culture of Russia, or political obligations, like the Ministry of Culture of the Moscow Region, which is not can influence the decisions of the regional government and the heads of municipalities close to it, while it is at this level that decisions that are destructive for the legacy are often made.
This is the situation, for example, has developed now with the Arkhangelskoye estate. According to the blog of the Moscow Regional Branch of VOOPIIK, the territory and the protected zone of the famous monument have been completely sold or leased for construction within several years. Until recently, only Rosokhrankultura held back the encroachments of investors: for example, in December 2010, the department rejected another project for adjusting the protection zones of the estate, received from the Ministry of Culture of the Russian Federation, according to which the territory of the ensemble was proposed to be reduced by 10 times.
